1. Purpose and Acceptance
These Terms of Service (ToS) govern access to and use of the Sublim Analytics platform (hereinafter "the Service"), published by Sublim SAS, a simplified joint-stock company registered in France. By accessing the Service, you unconditionally accept these ToS in their current version.
2. Service Description
Sublim Analytics is a web analytics SaaS platform designed to be simple, fast and GDPR-compliant. The Service enables the collection, analysis and visualization of website traffic data without using third-party cookies or transferring data outside the European Union.
3. Account Creation
Access to the Service requires creating a user account. You agree to provide accurate and up-to-date information, maintain the confidentiality of your credentials, and notify Sublim immediately of any unauthorized use of your account. You are responsible for all activities carried out under your account.
4. Subscriptions and Billing
Plans and pricing
The Service offers free and paid subscriptions. Current pricing is displayed on the Pricing page. Sublim reserves the right to modify its pricing with a minimum of 30 days' notice by email.
Renewal and cancellation
Any paid subscription is automatically renewed at the end of each period, unless cancelled before the renewal date from account settings. No refund is granted for periods already billed, except where required by law.
Payment
Payments are processed by Stripe (a secure payment provider). Sublim never stores your payment details. In the event of a payment failure, the account may be suspended after a 7-day grace period.
5. Acceptable Use
You agree to use the Service in compliance with applicable laws and these ToS. The following are prohibited:
- Collecting analytics data on websites you do not own or for which you do not have authorization.
- Attempting to gain unauthorized access to the systems or data of other users.
- Using the Service to collect sensitive personal data about your website visitors.
- Reselling or redistributing access to the Service without prior written consent from Sublim.
- Submitting unlawful, defamatory, or third-party rights-infringing content.
6. Data Ownership
Analytics data collected via the Service on your websites remains your property. Sublim acts as a data processor under the GDPR and only processes your data for the purposes of providing the Service. Sublim does not sell or share your data with third parties for commercial purposes.
7. Intellectual Property
All elements of the Service (source code, design, brand, content, algorithms) are the exclusive property of Sublim SAS and protected by French and international intellectual property law. Any unauthorized reproduction, modification or exploitation is strictly prohibited.
8. Availability and Service Levels
Sublim strives to maintain the Service available 24/7, with a monthly uptime target of 99.5%. Scheduled maintenance downtime is possible and announced in advance where possible. Sublim shall not be liable for interruptions caused by external factors (network failures, force majeure).
9. Limitation of Liability
The Service is provided "as is" and "as available". Sublim does not guarantee the absence of errors or the fitness of the Service for a particular purpose. Sublim's liability is limited, to the extent permitted by law, to amounts actually paid by the user during the 12 months preceding the event giving rise to the dispute. Sublim is not liable for indirect losses, loss of revenue or data.
10. Privacy and Cookies
The processing of your personal data and the use of cookies are governed by dedicated documents, accessible below. These documents form an integral part of these ToS.
11. Termination
Termination by the user
You may terminate your account at any time from Settings → Account → Delete account. Your data is deleted within 30 days.
Termination by Sublim
Sublim reserves the right to suspend or terminate access to the Service in the event of a breach of these ToS, persistent non-payment, or fraudulent use, after prior notice except in emergencies.
12. Amendments to the ToS
Sublim may amend these ToS at any time. Significant changes are notified by email at least 15 days before taking effect. Continued use of the Service after this period constitutes acceptance of the updated ToS.
13. Governing Law and Jurisdiction
These ToS are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution within 30 days. Failing agreement, the competent courts of Paris shall have sole jurisdiction.
